A 28-year-old male driver, R. Saktgaanapathy, was charged with murder on Wednesday, April 1, after allegedly driving under the influence of alcohol and drugs, resulting in the death of 33-year-old Amirul.
The incident occurred around 11:45 am, and Malaysian media reported that Saktgaanapathy appeared without legal representation, acknowledging the charge when it was presented to him.
No plea was entered, as murder cases fall under the High Court's jurisdiction. Amirul's wife, Nor Nadia Abdul Majid, attended the court proceedings and expressed relief at the murder charge against Saktgaanapathy.
Prior to the murder charge, South Klang police chief Lim Jit Huey stated that the accused was under investigation for dangerous driving causing death, a charge that could result in a maximum penalty of 15 years imprisonment and a fine of up to RM100,000 (approximately S$32,000).
The murder charge, however, carries a potential death penalty or imprisonment of up to 40 years. If the death penalty is not imposed, Saktgaanapathy could also face up to 12 strokes of the cane.
In a separate matter, he admitted to a charge under the Dangerous Drugs Act for self-administering benzodiazepine and tetrahydrocannabinol, the primary active ingredient in cannabis. Benzodiazepine is used to treat anxiety and related mental health conditions, and it is known to slow down brain activity.
This drug-related offence carries a fine of up to RM5,000 or imprisonment for up to two years.
Saktgaanapathy is scheduled to appear in court again on June 3.
